“From Fiscal Compact to Constitution: Shaping a Legal Form for the Balanced Budget Rule” is a research project funded by a joint research grant awarded for a period of 24 months (2014 - 2015) by the Romanian National Agency for Scientific Research and by the French Agence Nationale de la Recherche to Romanian and French research teams led by professors Elena-Simina Tănăsescu and Eric Oliva.
The aim of this project is to identify a legal mechanism for inserting in the national legal systems of Romania and France the balanced budget rules provided by the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union, signed on 2nd March 2012 in Bruxelles (also known as the Fiscal Compact) in a manner that will be complementary to the existing principles, rules and case law.
The work plan of the project foresees an international conference (link to page) to be held in Bucharest, in November 2014, and it will address the issue of the balanced budget as viewed at international and European level, including the perspective of international financial institutions, and a bilateral workshop (link to page) to be organized in Aix-en-Provence, in April 2015, which aims to comparatively evaluate results of the transposition of the balanced budget rule in French and Romanian national legal systems and further suggest corrective measures.
Intermediate results of the bilateral research were presented at two important international venues: the Congress of the International Association of Constitutional Law (Oslo, 16-20 June 2014), where a special panel is dedicated to the topic of “Constitutions and financial crisis”, and the Congress of the International Association of Comparative Law (Vienna, 20-26 July 2014), where a special workshop within the panel on Constitutional Law is reserved for the topic “Limitations on government debt and public deficit”.
Main deliverables of the project will be policy recommendations and the two publications resulting from the international conference and the bilateral workshop organised within the project, respectively a comprehensive book on the issue of the balanced budget with a global comparative view, and a bilingual book (in Romanian and French) that would gather the national implementation experiences of several EU countries. They will be disseminated to main university libraries as well as to public authorities potentially interested in such an evaluation.
